Safety Requirements for Equipment with Moving Parts
It has long been established that equipment with moving parts such as conveyer belts should not have missing safety guards. In 2000 The American National Standard Safety Standard for Conveyors and Related Equipment (AWSME B20.1-2000) stated:
"Where necessary for the protection of personnel from hazards, all exposed moving machinery parts that present a hazard to personnel at work stations … shall be mechanically or electrically guarded, or guarded by location or position…. In general, nip and shear points shall be guarded unless other means to assure safety are provided."
Insofar as punching machines also have a nip point, the same safety guard requirement arguably applies. Where conveyer belts or punching machines have no guards and injuries occur, a claim for design flaw is in order.
Should there be not be a plainly displayed warning of dangers, that too would be grounds for suit. If the equipment simply malfunctions, causing injury, the manufacturer would be strictly liable for a manufacturing defect.
